1. Acceptance of Terms
By downloading, installing, or using the Sola mobile application ("Sola", "the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Vernon Family (Pty) Ltd ("we", "our", "us"), the company that operates Sola.
2. Description of Service
Sola is a vitamin D tracking mobile application that provides personalised sun exposure recommendations, supplement logging, lab result tracking, and AI-assisted health guidance. The Service uses your skin type, geographic location, and real-time UV data to calculate safe and effective sun exposure times tailored to your body.
Key features of the Service include:
- Skin tone scanning and melanin-level detection
- Personalised daily sun session recommendations
- Vitamin D supplement logging and tracking
- Lab result recording and trend analysis
- Ask Sola AI assistant for health-related questions
- Analytics dashboard with daily scores and weekly trends
- Seasonal warnings and smart notifications
3. Account Registration
To use Sola, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account
Each person may maintain only one Sola account. We reserve the right to suspend or terminate accounts that contain false or misleading information.
4. Subscription and Payments
- Free Trial: Sola offers a 7-day free trial for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin.
- Subscription Plans: After the free trial, a paid subscription is required to continue using the Service. Plans are available at $7.99 per month (billed monthly) or $4.99 per month (billed annually at $59.88/year).
- Payment Processing: All payments are processed through the Apple App Store or Google Play Store, depending on your device. We do not directly handle your payment information.
- Cancellation: You can cancel your subscription at any time through your device's subscription settings (Apple Settings or Google Play). Cancellation takes effect at the end of the current billing period.
- Refunds: Refunds are handled by Apple or Google in accordance with their respective refund policies. Please contact Apple Support or Google Play Support for refund requests.
5. Health Disclaimer
This is an important section. Please read it carefully:
- Sola is a wellness tool designed for informational and educational purposes. It is not a medical device.
- The recommendations provided by Sola are based on general health science and your personal profile. They do not constitute medical advice.
- We do not diagnose, treat, cure, or prevent any disease or medical condition.
- Always consult a qualified healthcare provider before making changes to your vitamin D supplementation, sun exposure habits, or any aspect of your health regimen.
- Sun exposure carries inherent risks, including sunburn and increased risk of skin cancer. Always follow safe sun practices and never exceed recommended exposure times.
- Supplement recommendations provided by Sola are for informational purposes only. Dosage and suitability should be confirmed with your doctor.
- The Ask Sola AI assistant is powered by artificial intelligence and may produce inaccurate or incomplete responses. Do not rely on it for medical decisions.
6. Acceptable Use
You agree to use Sola in accordance with these Terms and all applicable laws. You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
- Share your account credentials with others or allow multiple people to use a single account
- Use automated tools, bots, scrapers, or other software to access or interact with the Service
- Attempt to gain unauthorised access to our systems, servers, or other users' data
- Interfere with or disrupt the integrity or performance of the Service
- Reproduce, distribute, or create derivative works based on the Service without our express written permission
7. Intellectual Property
All content, features, functionality, design, code, graphics, logos, and trademarks associated with Sola are the exclusive property of Vernon Family (Pty) Ltd and are protected by applicable intellectual property laws.
The Sola name and logo are trademarks of Vernon Family (Pty) Ltd. You may not use our trademarks without our prior written consent.
You retain ownership of any personal data you provide to the Service. By using Sola, you grant us a limited licence to use your data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any health outcomes, injuries, or adverse effects resulting from actions taken based on the App's recommendations, including sun exposure times, supplement suggestions, or AI assistant responses.
- In no event shall our total liability to you exceed the amount of subscription fees you have paid to us in the twelve (12) months preceding the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe that you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.
You may terminate your account at any time by deleting your account through the Settings screen in the App. Upon account deletion, all of your personal data will be permanently removed from our systems in accordance with our Privacy Policy.
Sections relating to intellectual property, limitation of liability, and governing law shall survive termination of these Terms.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
